1. Overview

This Refund and Dispute Policy (“Policy”) outlines the procedures for cancellations, returns, refunds, and disputes between Buyers and Sellers on BidHaggle.com.
Bid Haggle LLC operates as a marketplace facilitator and not as the seller of record.
Each Seller is responsible for the accurate representation and delivery of their products, but all transactions are subject to this Policy and applicable law.
This Policy applies to all users, including those located in the United States, the European Union (EU), and China.
Local consumer protection laws take precedence if they provide stronger rights.


2. General Principles

  • Bid Haggle LLC acts as a venue for Buyers and Sellers to complete transactions.

  • Buyers and Sellers are the contracting parties for any purchase or trade.

  • Sellers may set their own refund and return policies, provided they comply with applicable laws.

  • If a Seller has not posted a policy, the default rules in this document apply.

  • Bid Haggle LLC may mediate disputes but is not obligated to issue refunds except as outlined herein.


3. Buyer Cancellations and Refunds

United States

  • Buyers may cancel an order within 24 hours of purchase if the item has not yet been shipped.

  • Once shipped, cancellations are no longer guaranteed and refunds depend on the Seller’s policy or item condition.

  • Refunds may be issued if the item is not as described, damaged, or never received.

European Union (EU)

  • Buyers have a 14-day “right of withdrawal” (cooling-off period) beginning the day after receiving the goods, unless the item is exempt (custom-made, digital downloads, sealed hygiene items, perishables).

  • When the right of withdrawal is exercised, the Seller must refund the full amount within 14 days after receiving the returned goods or proof of return.

  • Buyers may be responsible for return shipping costs unless otherwise stated by the Seller or required by EU law.

China

  • Under Chinese consumer protection law, most items qualify for a “seven-day no-reason return” policy unless exempt (e.g., custom goods, perishables).

  • Sellers must comply with Chinese e-commerce platform rules and provide standardized after-sales service options.

  • Refunds must be processed promptly once the returned goods are confirmed received.


4. Filing a Dispute

  1. A Buyer must file a dispute through the Bid Haggle platform within 14 days of delivery or expected delivery date.

  2. The Buyer must include all relevant information and evidence (e.g., photos, order ID, description of issue).

  3. The Seller must respond within three (3) business days and propose a resolution.

  4. If the Buyer and Seller cannot reach an agreement, Bid Haggle LLC may act as a neutral mediator.

  5. Bid Haggle LLC’s decision may include refund, replacement, partial credit, or denial of claim.

  6. Funds may be temporarily held until a dispute is resolved.


5. Returns and Inspection

  • Buyers must return goods using reasonable, trackable shipping methods and packaging.

  • The Seller may deduct from the refund if items are returned damaged, incomplete, or show signs of unreasonable wear and tear.

  • If the Seller refuses a valid return or fails to provide a return address, Bid Haggle LLC may authorize a refund to the Buyer without requiring item return.

  • For trades (item-for-item exchanges), both parties must complete shipment as agreed; otherwise, the dispute process applies.


6. Exclusions

Refunds and returns are not available for:

  • Digital or downloadable goods once delivered.

  • Custom-made or personalized products.

  • Sealed hygiene or health products once opened.

  • Perishable or consumable goods.

  • Any claim made after the stated timeframes or without supporting evidence.


7. Chargebacks and Fraud

  • Buyers who initiate chargebacks through their payment provider must also contact Bid Haggle support with evidence of the issue.

  • Sellers must provide proof of shipment and communication to contest chargebacks.

  • Bid Haggle LLC reserves the right to impose penalties, holds, or account suspensions for misuse or fraudulent activity by either party.

  • Repeated abuse of the refund or dispute process may lead to permanent account termination.


8. Resolution and Governing Procedures

  • U.S. Users: All unresolved disputes are subject to binding arbitration in California, except small claims cases.

  • EU Users: Consumers may use local courts or the European Commission’s Online Dispute Resolution (ODR) platform.

  • China Users: Disputes arising from China-based transactions are governed by local consumer and e-commerce laws.

  • This Policy does not override any non-waivable consumer rights granted by applicable laws in your country or region.
